Hi everyone I am new to the forum hope you are all well. The reason I joined the forum was to see if anyone could guide me in the right direction to challenge a CCJ which was issued to my wife for an unpaid credit card issued by Debenhams.
She usually used the card to purchase promotional goods so that she could get the promotional discounts, she would then pay for the goods emediatly afterwards, usually before she left the store.
Well at leaste that was her strategy, however over the period on one week from 31st July 2007 to 8th August 2007 she purchased some goods prior to our hoildays, without paying for the goods as she usually does.
She completely forgot about the purchases until we recieved a letter from a solicitor this week explaining she had recived a county court judgement at Nothampton Couty court for £791.59.
At first we thought it was a mistake and could not relate the figure to any purchases. She telephoned the solicitor and explained we did not understand what the debt related to and that we had not had any prior notice or any demands.
It turned out the the letters for demand had been sent to our previous address which we left in April 2007. They stated they had sent 3 letters to my old address and we had not acted. I explained that we had set up a mail redirect service when we left the other address so we should have got the mail, also that my wife had informed debehams of our new address.
Today my wife went to our old address and fortunaltely the new occupier had kept all mail addressed to us, so we discoved the letters only today. The mail also contained an invoice from Debenhams for the purchases totalling £285.51.
I found out today from the Royal Mail that the redirection of mail only applies to letters sent by Royal Mail, no other carrier is redirected.

My question is, is it possible to get the mattter looked at again by the court once the judgement is made, can this be challenged at all.
To day I have paid the debt in full as we admit we overlooked the payment but if we had recieved the mail it would not have come to this. Can anyone advise, any thanks anyway.
Geoff
