Today I have recived a claim form from a county court its wishing to impose a CCJ on me but my worry is on what steps to take.

This CCJ is only from one of the several unsecured creditors.

My partner has joined me from abroad and will be applying for settlement in UK in a few months.

Will my partners application for settlement be effected in any way if a CCJ is imposed on me ?

I dont own a home or a car I am living with parents and so is my partner.

I am registerd disabled and am receiving DLA £236 per month and some other money from odd jobs leefleting about £100 Per month I am not claiming any other benifits.

I am thinking of taking steps to declare self bankruptcy, please advice me if this is a better option for me or is there any other way to resolve this matter ?

Thank you for your post.

I would like to give you the answer to your question, but regrettably, my colleagues and I are unsure if the CCJ will affect your partner’s application for citizenship. I would suggest that you are honest about the CCJ at all times should the relevant authorities query your finances. Honesty is always the best policy.

As you are on benefits you are not eligible to apply for an IVA, but you may wish to consider discussing your financial affairs with a debt counsellor.

If you wish to petition for bankruptcy, you may do so by contacting the Bankruptcy Clerk at your local County Court, though I feel that the repercussions of bankruptcy may be more detrimental to your partners' residency in the UK than a CCJ would.
